GENERAL TERMS AND CONDITIONS (T&Cs)

1. Scope
All deliveries, services, and offers via the Baur au Lac online shop are operated by
H. KRACHT’S ERBEN AG (CHE-106.100.014)

(hereafter referred to as the "Baur au Lac Shop")

are exclusively subject to these General Terms and Conditions, even if not expressly agreed upon again. By placing an order, the customer accepts these conditions. Any customer’s own terms of purchase are hereby excluded. Changes to these terms are only valid if confirmed in writing by H. KRACHT’S ERBEN AG.

These T&Cs apply in their current version at the time of contract conclusion. Customers may print or save this document depending on their device.

2. Offer
Prices and product listings are not legally binding offers but an invitation to submit an order. Offers are subject to availability.

3. Prices
Our shop operates in Swiss Francs. Any foreign currency figures are indicative and only binding upon order confirmation at the daily rate.
All prices include VAT.
Prices may change; the price at the time of order applies.
The prices listed in the order confirmation are binding for in-stock items. For specially sourced products or supply delays, the daily price at the time of ordering applies.
Prices include VAT and, unless otherwise agreed, exclude shipping costs. Published prices may change; errors reserved.

4. Contract Conclusion
By clicking the order button, the customer places a binding order. An order confirmation follows promptly. The order becomes binding only after written confirmation. If delivery is not possible post-confirmation, or pricing errors are found, the order may be cancelled, or price differences charged post-delivery.
If the customer disagrees with a price correction, they may return the item. No further claims may be made.

Partial deliveries and invoices are allowed. Additional shipping costs for partial shipments are covered by us. Delays will be communicated promptly.
Accepted payment methods are those shown during checkout.
Product visuals and descriptions serve as guidance only and are not guaranteed unless explicitly stated.

If a customer exceeds their credit limit, Baur au Lac Shop may withdraw from fulfilling the order.
We do not sell alcoholic beverages to individuals under 16 or spirits to those under 18. Age verification may be required.

5. Delivery Conditions
We deliver within 10 days to addresses in Switzerland and Liechtenstein.
Delivery times are estimates unless confirmed in writing. They depend on our suppliers’ performance.
Discrepancies in quantity must be reported immediately or within 4 days for hidden defects. Report any damage, delays, or poor packaging upon receipt.

6. Transfer of Risk
Risk transfers to the customer once the shipment is handed to the carrier. If shipping is delayed for reasons beyond our control, risk transfers upon notice of dispatch readiness.
For collections, risk transfers upon contract conclusion or readiness notification.

7. Warranty
Should goods arrive faulty or incorrect, we will either replace the item or refund the purchase.
Return postage for faulty or incorrect items will be reimbursed.
Minor deviations from descriptions do not qualify for warranty claims. Normal wear and improper use are not covered.
Faults must be reported within 14 days via email, phone, or post.

8. Liability
These T&Cs cover all contractual claims and their consequences. We accept no liability for damages not directly related to the product.
This includes personal liability of our staff and representatives.
Our liability does not exceed the order value, unless caused by wilful misconduct or gross negligence.
Products must be used as intended.

9. Refusal of Acceptance
If a customer refuses the order after a grace period, Baur au Lac Shop may cancel the contract and claim damages—either 25% of the order value or actual loss incurred.

10. Returns
Customers may return goods within 30 days of delivery. Returns are accepted only for unopened, unused products.
Returns must be announced in advance.
Perishables, hygiene products, and consumables are excluded.
A valid return turns the purchase into a refund process.
Refunds will be credited to the original payment method or customer account, minus any damages, misuse, or agreed shipping costs.
We reserve the right to withhold the refund until the returned goods arrive or proof of return is provided.

The customer is responsible for proper packaging. Damages due to poor packaging are charged.
Responsibility for safe transit lies with the customer until the goods arrive at our premises.

11. Payment
Only the payment methods offered in the online shop are accepted.

12. Customer Reviews
Customer reviews may be displayed on our online shop, website, app, or social media. We may choose to shorten or remove reviews for legal reasons (e.g., privacy concerns).
Reviews reflect customer opinions, not necessarily those of Baur au Lac Shop.

13. Data Protection
We handle customer data in line with privacy regulations. Details are outlined in our privacy policy, which is part of these T&Cs. Accepting the T&Cs includes consent to the privacy policy.

14. Copyright
All brands, trademarks, images, and logos used in the Baur au Lac online shop belong to their respective owners.

15. Jurisdiction
The exclusive place of jurisdiction is Zurich.
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

16. Final Provisions
Contracts are concluded in German and English only.
We may amend these T&Cs at any time. The current version is available for viewing and printing on our webshop.
If any clause becomes invalid, all other clauses remain in effect. The relevant legal provision shall apply in place of the invalid one.
